Uncontested Divorce
This legal process is designed for couples who agree on key issues, such as child custody, spousal support, and division of assets. By avoiding disputes that require resolution in court, uncontested divorces tend to be quicker, more cost-effective, and less adversarial when compared to contested divorces. Typically, the process involves finalizing details many couples are not aware are even necessary, drafting and submitting appropriate Court filings, attending a brief hearing, and obtaining a divorce decree. In many cases, we can help couples avoid even having to physically appear in court.
Contested Divorce
A contested divorce occurs when a couple cannot agree as to certain issues or where either or both parties want verification of certain facts (usually financial) before agreeing to settle. In a contested divorce, a divorce action is initiated in court and each party can ask the other party questions and demand documents. This allows for identification and verification of each party’s positions.
In family-held or small-business situations, appraisers are often used to establish values. If custody is in dispute, a special investigator ( a “Guardian ad Litem”) is usually appointed to review all the facts and circumstances and make a determination, which is often, but not necessarily, accepted by the Court as to the best custodial situation for the children. Typically, once the information sought, appraisals, and Guardian ad Litem input have been obtained, the parties will mediate to try to settle the case without the necessity of trial. If certain issues need to be resolved before the divorce is finalized, then temporary hearings to address the issues can be held.
